End User License Agreement NANO Antivirus

  1. Terms and definitions

    1. This End User License Agreement (EULA) is an agreement between the individual end user (you) and “BiZone” Limited Liability Company, the rights holder to the NANO Antivirus software product (“BiZone” LLC or we). This EULA applies to the software product specified above. The software product shall be provided and used on the terms and conditions of this EULA and shall include the software together with any related media, printed materials, electronic documentation, applications, and other components (Product).
    2. NANO Antivirus. A software product designed to protect a personal computer (PC) against malware.
    3. Standard License. A license that permits installation of the Product on a predetermined number of devices for a predetermined term.
    4. Multi-device License. A license that permits installation of the Product on several devices in accordance with the usage rules applicable to such licenses, and may have a varying term.

  2. Acceptance of this EULA and grant of licenses

    1. By installing, copying, or otherwise using the Product, you acknowledge that you have read this EULA, understood its terms, and agree to use the Product in accordance with this EULA.
    2. This EULA shall be deemed effective upon your first use of the Product or your express acceptance of all of its terms by selecting the applicable acceptance option during Product installation or upon the first launch.
    3. If you do not agree to any provision of this EULA, you may not use the Product and shall immediately discontinue using it. We may amend this EULA at any time, unilaterally and without notice. Any revised version of this EULA becomes effective upon its publication on www.nanoav.ru.
    4. We grant you a nonexclusive license to use the Product (License). The License includes the right to install and run the Product in PC memory subject to the limitations set forth in this EULA and to the extent consistent with the Product functionality; the right to use the Product functionality and obtain the results produced through such use.
    5. If you breach this EULA, we may unilaterally terminate this EULA and the License without compensating you for any losses.
    6. We reserve the right to terminate the License if bankruptcy or liquidation proceedings are commenced with respect to “BiZone” LLC, or if activities relating to the development and/or support of the Product cease.

  3. Product use

    1. The Product provided under this EULA may be used only for the duration of the license term and on the number of PCs specified by the applicable License. We may extend the term at our discretion in connection with marketing activities. If multiple operating systems, including virtual environments, are installed on a single PC, each such operating system or virtual environment shall be treated as a separate device.
    2. You agree that the aggregate number of protection days for all devices with an activated Multi-device License may not exceed the limit applicable to the Multi-device License plus any bonus days awarded.
    3. The Product is intended solely for personal (noncommercial) use on home PCs.
    4. The Product may be provided on several media, including via the Internet. Regardless of the number of media on which you receive the Product, you may use only the number of copies permitted under your License.
    5. Files received from you are scanned for malicious code to provide you with an online verdict on the submitted file or to update antivirus databases without notice.
    6. Technical information is used to identify issues you may encounter and to recommend possible solutions. Such files and technical information may be subject to additional analysis and used for statistics, product improvement, and similar purposes without notice.

  4. Intellectual property and copyright

    1. The Product and all of its components, including documentation, trademarks, graphic elements, algorithms, operating principles, etc. are the intellectual property of “BiZone” LLC and are protected by applicable Russian and international laws. Any use of such intellectual property independently of the Product is prohibited.
    2. “BiZone” LLC warrants that it holds all rights necessary to license and distribute the Product.

  5. Use restrictions

    1. You may not:
      • use the Product in any manner not permitted by this EULA, including modifying or altering the Product or its components, or using the Product or its components to create derivative or composite computer programs
      • use the Product as part of any other software products (including services)
      • circumvent or attempt to circumvent any technical limitations or security controls of the Product
      • decompile, disassemble, reverse engineer, decrypt, inspect, or otherwise attempt to obtain the Product’s source code or internal structure
      • develop (create), based on the Product, own software that partially or fully replicates the Product’s features, algorithms, or software concepts
      • take any action intended to test, analyze, or assess vulnerabilities in the Product without our prior written consent
      • distribute, sell, lease, rent, sublicense, publish in open sources, or otherwise provide the Product installation package or any right to use the Product to third parties
      • use software tools to access the Product for the purpose of extracting, collecting, processing, copying, and/or subsequently distributing information or data contained or stored in the Product
      • use malicious software or take any action intended to disrupt Product operation or functionality
      • use the Product in violation of applicable law or third-party rights and legitimate interests, including by using the Product on devices of third parties without their consent
      • use the Product to provide services to third parties, including information security services
      • use the Product to take any action intended to compromise the security, resilience, or availability of the IT infrastructure of “BiZone” LLC or any third party
      • remove or alter any copyright notices contained in the Product
    2. Upon ceasing to use the Product, and in any event within one (1) business day after the expiration of the term of use, you shall completely remove the Product from your device, including any media connected thereto. The Product shall be removed using the native uninstall functionality of the applicable operating system. You shall also delete all copies of the Product’s distribution files, installation packages, and backups in your possession and, to the extent reasonably practicable, delete from your device’s file systems any residual or temporary files and directories created during Product installation or use.

  6. Disclaimer

    1. The Product and all of its components, including updates, are provided “as is.”
    2. We make no warranties of any kind with respect to the Product, and you use it at your sole risk. Under no circumstances shall we be liable for any damage arising from the use of the Product, including lost profits.
    3. We do not warrant that the Product will operate on operating systems that are no longer supported by their official vendors.
    4. We do not warrant that the Product will operate on any operating system with vendor restrictions, regardless the nature or reason for such restrictions, on interactions between the operating system (including its services and applications) and third-party software.
    5. The Product is provided “as is.” We make no warranty and assume no liability with respect to, among other things, the Product’s error-free operation, continuity or speed of operation, the accuracy or reliability of results obtained through use of the Product, the Product’s failure to meet your expectations, compatibility with other software, or the Product’s operation on third-party devices or hardware.
    6. You shall be solely responsible for ensuring the availability and proper functioning of your device required to use the Product, including any hardware, software, operating systems, communication channels, and internet access. We shall not be liable for any inability to use the Product resulting from defects in or inadequacy of such device.
    7. Circumstances beyond our reasonable control, including failures of communication networks, data centers, software, operating systems, or third-party equipment, acts of telecom operators, internet service providers, owners or administrators of information systems and resources, shall not constitute a breach of our obligations and shall not give rise to any liability.
    8. We shall not be liable for losses arising out of the use of the Product or inability to use the Product, including loss of data, lost profits, or other indirect losses. Nothing in this EULA shall limit our liability to the extent such limitation is prohibited by applicable law.
    9. You shall be solely liable for your actions in connection with use of the Product. We shall not be liable for any consequences of your using the Product. If any third party, including any state authority, asserts a claim or demand against “BiZone” LLC in connection with your using the Product, including in violation of this EULA, you shall, at your own expense, resolve such claim or demand and reimburse us for any resulting losses.

  7. Warranty Support

    1. During the Product term of use, but in any event, within twelve (12) months from the commencement of such term, we may provide you with warranty support for the Product limited to: (i) rectifying defects in the Product; and (ii) providing patches and/or Product updates for purposes of such warranty support. Defects mean the Product’s nonconformities with the requirements and specifications set forth in the technical documentation, including with respect to its operability, functionality, or composition, where such nonconformities prevent normal operation of the Product. The resolution time for warranty requests is determined by us.
    2. You can request for Product warranty support at support@nanoav.ru.
    3. Warranty support for the Product begins upon the first activation of the first License provided, regardless of the activation method.
    4. All matters relating to Multi-device Licenses, including License deactivation, activation errors, and similar issues, shall be handled exclusively through our warranty support.

  8. Privacy Policy

    1. We place a high priority on the security of information received from you. Our Privacy Policy is available at the specified address.

  9. Governing law

    1. The relationship under this EULA shall be governed by the applicable laws of Russia.
